1. Acceptance of Terms

By accessing or using StackBloom's services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services. These terms apply to all visitors, users, and customers of StackBloom.

2. Description of Service

StackBloom is an all-in-one productivity SaaS platform offering 13+ integrated applications. Our platform provides:

  • One-time Purchases: Most products offer lifetime access with a single payment
  • Monthly Subscriptions: Infrastructure-heavy apps (Monitor, Live Chat, HealthBloom) require monthly billing
  • Product Updates: All purchases include ongoing updates and improvements
  • Customer Support: Access to documentation, help resources, and support team
  • Unified Dashboard: Single account to manage all your StackBloom products
  • Tiered Access: Different pricing tiers (Starter, Pro, Business, Enterprise) with varying features

3. Lifetime Access Definition

"Lifetime Access" means you have the right to use the purchased product for as long as the product is maintained and supported by StackBloom. This applies to our one-time purchase products:

  • Forms Builder (Starter, Pro, Business tiers)
  • PDF Suite (Basic, Pro, Business, Enterprise tiers)
  • E-Sign (Basic, Advanced, Enterprise tiers)
  • Scheduling (Starter, Pro, Business tiers)
  • Proposals (Starter, Professional, Premium tiers)
  • Automations (Starter, Pro, Business, Enterprise tiers)
  • TableBloom (Basic, Pro, Business, Enterprise tiers)
  • InboxBridge (Basic, Advanced, Enterprise tiers)
  • URL Shortener (Starter, Pro, Business tiers)
  • Email Signature Generator (Lifetime tier)

Lifetime access includes all updates, bug fixes, and improvements to the product. We reserve the right to discontinue products with 90 days notice, though existing users will continue to have access to the last available version.

Monthly Subscription Products

The following products require active monthly subscriptions:

  • Monitor: Uptime monitoring with infrastructure costs (Basic, Pro, Business, Enterprise tiers)
  • Live Chat: Real-time chat with server requirements (Starter, Pro, Enterprise tiers)
  • HealthBloom: Medical practice management with HIPAA compliance (Starter, Professional, Clinic tiers)

Subscriptions can be cancelled at any time. Access continues until the end of the current billing period.

4. User Accounts

To use StackBloom services, you must:

  • Create an account with accurate information
  • Maintain the security of your account credentials
  • Be at least 18 years old or have parental consent
  • Not share your account with others
  • Notify us immediately of any unauthorized access

5. Acceptable Use

You agree not to:

  • Use our services for any illegal purpose
  • Attempt to reverse engineer, decompile, or hack our products
  • Resell or redistribute our products without authorization
  • Use our services to harm others or our systems
  • Violate any applicable laws or regulations
  • Share account credentials with unauthorized users

6. Payment and Refunds

StackBloom offers two payment models depending on the product:

  • One-time Payments: Most products (Forms, PDF Suite, E-Sign, Scheduling, Proposals, etc.) require a single lifetime payment
  • Monthly Subscriptions: Infrastructure-heavy apps (Monitor, Live Chat, HealthBloom) require monthly recurring payments

7. Intellectual Property

StackBloom and its products are protected by copyright, trademark, and other intellectual property laws. You receive a license to use our products, not ownership of the underlying code or assets.

Your Data

You retain all rights to content you create or upload using StackBloom products:

  • Forms and form submissions
  • PDF documents and annotations
  • E-signed documents
  • Proposals and content
  • Automation workflows
  • All other user-generated content

License Grant to Us

You grant us a limited license to store, display, and process your content solely to:

  • Provide the services you purchased
  • Create backups for data recovery
  • Improve our products and services
  • Comply with legal obligations

We will never use your content for marketing or sell it to third parties.

Restrictions

You may not:

  • Copy, modify, or reverse engineer our software
  • Resell or redistribute StackBloom products
  • Remove copyright notices or branding
  • Create derivative works based on our products
  • Use our trademarks without written permission

8. Limitation of Liability

StackBloom is provided "as is" without warranties of any kind. We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services. Our total liability shall not exceed the amount you paid for the product in question.

9. Termination

We reserve the right to suspend or terminate your access to our services for violations of these terms, fraudulent activity, or other legitimate business reasons. Upon termination, your right to use our products ceases immediately.

10. Service Availability and Uptime

We strive to maintain high availability for all StackBloom services:

  • We target 99.9% uptime but do not guarantee uninterrupted service
  • Scheduled maintenance will be announced in advance when possible
  • We are not liable for service interruptions due to circumstances beyond our control
  • Data backups are performed regularly, but you should maintain your own backups of critical data

11. Data Privacy and Security

We handle your data as follows:

  • We comply with GDPR, CCPA, and other applicable data protection regulations
  • All data transmission is encrypted using TLS 1.3
  • Sensitive data is encrypted at rest in our databases

12. Governing Law and Dispute Resolution

These terms are governed by the laws of the United States and the State of Delaware.

In the event of any dispute:

  • You waive the right to participate in class action lawsuits
  • Each party bears their own legal costs unless otherwise awarded

13. Indemnification

You agree to indemnify and hold StackBloom harmless from:

  • Your violation of these terms
  • Your violation of any third-party rights
  • Any content you create or upload through our services

14. Changes to Terms

We may modify these terms at any time. Significant changes will be communicated via email or through our platform at least 30 days in advance. Continued use of our services after changes become effective constitutes acceptance of the modified terms. If you don't agree to the changes, you may cancel your account.

15. Severability

If any provision of these terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the remaining terms remain in full force and effect.
